Monica Burneikis Luca

Practice Overview

Monica Burneikis is an associate in the firm’s San Jose office and is a member of the Litigation Group.  Her practice focuses on all aspects of civil litigation, including case evaluation, alternative and early dispute resolution, formal discovery, trial, post-trial, and appellate matters.

Monica’s expertise includes medical malpractice, personal injury, wrongful death, elder abuse, and general civil litigation matters.  Her extensive experience defending both hospitals and individual physicians in professional malpractice lawsuits gives her a unique perspective in the handling of medical malpractice, personal injury, wrongful death, and elder abuse cases on behalf of plaintiffs.  Monica is well versed in all aspects of pretrial practice, and has written and successfully argued a number of dispositive motions. 

Monica’s clients appreciate her dedication to working on their behalf in an efficient and cost-effective manner, while always vigorously advocating for their interests.  She also prides herself on her responsiveness to her clients, and embraces Hoge Fenton’s firm-wide commitment to outstanding client service.

Representative Matters

  • Obtained numerous favorable judgments for several major Bay Area Hospitals and individual physicians in medical malpractice actions via successful summary judgment motions

  • Extricated internationally celebrated nonprofit organization from large personal injury lawsuit by effectively writing and arguing a vehemently opposed Motion for Determination of Good Faith Settlement

  • Successfully wrote and argued motion to compel production of documents vigorously challenged by opposing counsel on grounds of attorney-client and work product privilege

Professional Activities

While at Santa Clara University School of Law, Monica was a recipient of the Dean’s Fellowship Scholarship, and was an Honors Moot Court Participant.  She is an active member of the American Bar Association and the Santa Clara County Bar Association, and currently serves as a member of the Santa Clara County Bar Association’s Civil Practice Committee.
